All model year (MY) 2009 transport refrigeration unit (TRU) engine owners must be aware that if they want to qualify for compliance extensions, only one week remains before the purchase order deadline for ordering Level 3 verified diesel particulate filters (DPF) for retrofitting your reefer engines.

MY 2009 TRUs and TRU generator set engines must comply with the TRU Regulation’s in-use performance standards by December 31, 2016. Owners also need to be aware that replacement engines are no longer a compliance option because replacement engines must be cleaner than the old engine being replaced; there is no replacement engine that fits and functions that is cleaner than an MY 2009 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm).

The TRU Regulation does not allow compliance extensions if orders for verified diesel emissions control strategies, such as Level 3 DPFs, are placed after October 31st and installation is not completed by December 31st, 2016. However, if MY 2009 TRU engine owners order verified diesel emissions control strategies (VDECS), such as Level 3 DPFs, by the end of October, installation by the end of 2016 is very likely possible. More importantly, if owners order a Level 3 DPF before October 31st and delivery or installation is delayed so that they cannot comply by the end of 2016, those owners may qualify for a compliance extension.

To qualify for compliance extension, owners must ensure  that :

  • Purchase orders for Level 3 DPFs are placed by October
    31st
  • The TRU is registered in ARB’s Equipment Registration
    (ARBER) system
  • An application for extension has been submitted to ARB with the
    required documentation by December 31, 2016

To reinforce, MY 2009 TRU engine owners that place orders for Level 3 VDECS after October 31st will not qualify for this compliance extension if they discover they cannot comply by December 31st due to delays in delivery or installation.
